It seems that the main constitutional challenge when it comes to Obamacare is the individual mandate.  In my personal view that provision is unconstitutional and it will or should be overturned by the Supreme Court or repealed after the elections. The question is, how can insurance companies be expected to change their policies on pre-existing conditions without the individual mandate? What is to stop an already sick individual from getting insurance after becoming sick?  I like the analogy of buying car insurance after your accident.  No car insurance company would pay for the damages sustained in an accident which occurred prior to your coverage and from a risk management standpoint they couldn't.  Health insurance companies are the same way.  It might sound harsh because a person’s health is different than a dent in a car but am I wrong?

No I dont think your wrong with your analogy, it just might too extreme. Its important to understand that "obamacare" will not cover ALL exisisting conditions. If Im  correct, and I think I am, it will only cover those conditions that are not terminal and that most cover already. The idea of Obama care is to allow the opportunity for those who have never had insuarance to become insurable. Most of the conditions that will be covered will be predictable and will still maintain a healthy profit for the insurer.
