You need to know what the fifth amendment to the constitution states. Here it is in compact form:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
To pick out the specific points of that overly complex, stupid runon sentence:
-
you can't be charged for a capital or infamous crime unless you first go up against a grand jury or if the US is at war and in immediate danger.
-
you can't be charged twice for the same crime.
-
they can't make you testify against yourself
-
they have to go through all the copies in triplicate, dragging of chains, party of the first part'ing, and dotting and crossing before they can kill you, set you free, or take all you got.
-
they can't take your property and use it for the government unless they pay you.
That is the sum total of the fifth amendment. You may have been looking for a different amendment.
